This course explores how the law shapes the international financial system and the behaviour of its participants. It examines the governance structure of international finance, including the roles played by national regulators (such as central banks) and international bodies (such as the BIS, FATF, FSB, IMF, IOSCO, World Bank and many others). It tackles the difficult questions about the future of the global financial system. How could the existing global financial architecture be improved at the national and international level? How should the law respond to the recurrent financial crises? To what extent is legal harmonisation feasible in the area of international finance? This course is vocationally relevant to those who work, or want to work, for law firms with a banking and finance or capital markets practice, regulatory agencies, banks and other financial institutions. It is of general educational relevance to anyone who wishes to understand the forces shaping the global financial order.
